ORDER 1.

We are passing this order in continuation to the earlier orders dated 06.07.2023, 07.07.2023, 11.09.2023, 30.11.2023, 08.11.2024, 03.12.2024 and 13.02.2025.

In compliance with our previous order dated 13.02.2025, Respondent No.1- Padmabhushan Vasantdada Patil Government Hospital, Sangli has filed reply affidavit dated 10.03.2025, in which it is recorded that vide letter dated 17.12.2024, a proposal to set up the ETP, STP and underground drainage system was submitted to the Commissioner, Medical Education and Research, Mumbai for administrative approval, which is still under consideration.

In view of above submission by Respondent No.1, it appears that the process of setting up of the ETP, STP etc. at the hospital in question is at the very initial stage.

In compliance with our previous order, Respondent Nos.3 & 4- MPCB has already calculated the amount of EDC to be levied from Respondent No.1 to the tune of Rs.4,32,00,000/- for the period from 01.04.2012 to 28.01.2024 and the amount of Rs.30,60,000/- towards additional EDC.

But it is submitted by learned counsel for Respondent Nos.3 & 4 that the said amount has not been deposited by Respondent No.1 so far.

Waiver of the above-mentioned amount is prayed by learned counsel for Respondent No.1 before us. before us.

But we do not find any reasonable ground to waive the said amount to be deposited by Respondent No.1 because no serious efforts appear to have been taken so far by Respondent No.1 for setting up the ETP, STP etc. at an early point of time nor has any timeline been given by Respondent No.1 as to by when the same would be set up.

Hence, we direct Respondent No.1 to deposit the said amount of EDC with the MPCB within a period of two months from the date of uploading of this order.

This amount shall be utilized by the MPCB for setting up the ETP, STP etc. at the hospital in question.

We may make it clear here that the amount of EDC would continue to be enhanced if the ETP, STP etc. are not set up at the hospital in question at the earliest.

As far as the setting up of the same, we may make it clear here that when Respondent No.1 would make a demand for release of the amount from the MPCB for the purpose of setting up of the ETP, STP etc. at the hospital in question, the same shall be released without any delay.

With the above direction, we dispose of this application accordingly.
