In compliance with our previous order, learned counsel for Respondent No.2- SEIAA has filed reply affidavit dated 13.06.2025, wherein it is submitted that the present Original Application has become infructuous, to which learned counsel for the applicant has raised objection and seeks two weeks’ time to file rejoinder affidavit against the same.
We grant him the said time.

Learned counsel for Respondent No.2 has also moved I.A.
No.181/2025(WZ) seeking recall of the order dated 23.04.2025 passed by us, by which cost of Rs.5,000/- was imposed upon Respondent No.2 for non-submission of the reply affidavit in time.
He submits that because of Page 2 of 2 the frequent changes of the Officials/Officers in the Department, reply affidavit could not be filed in time.
There was no deliberate delay on their part and in these circumstances, the said cost may be waived of.

In view of above submissions, we allow I.A.
No.181/2025(WZ) and waive of the cost of Rs.5,000/- to be deposited by Respondent No.2.
I.A.
No.181/2025(WZ) stands disposed of accordingly.

Registry is directed to list this matter, particularly, to decide the issue as to whether the present Original Application has become infructuous on 25.07.2025.
