Rajeev Chopra resident of village Pali, Post Office Bhogpur, District Dehradun has sent by post the present letter petition, which has been treated and registered as original application, complaining that for construction of community center in khasra no.

46 and 47 at villages Majhola-Rakhwal, Block Doiwala, Tehsil Rishikesh, District Dehradun seven green trees have been illegally cut and encroachment has been made on storm water drain.

Vide order dated 30.08.2022 this Tribunal constituted a Joint Committee comprising of representative of Ministry of Jal Shakti, State of Uttarakhand, State PCB, DFO and District Magistrate, Dehradun with direction to submit its report within one month.

Rajeev Chopra resident of village Pali, Post Office Bhogpur, District Dehradun, which is treated and registered as original application, is regarding illegal encroachment on storm water drain of Khaldar and cutting of seven big grees for construction of community centre at village Majhola-Rakhwal, Block Doiwala, Teshil Rishikesh, District Dehradun” के अनु म म िन अिधका रयों की संयु सिमित का गठन िकया गया। 1. िजलािधकारी, देहरादून । 2. जलश मं ालय, उ राखंड। 3. भागीय वनिधकारी , देहरादून वन भाग, देहरादून। 4. उ राखंड दूषण िनयं ण बोड , देहरादून। करण के संबंध म गिठत सिमित एवं िन अिधका रयों / सद ों ारा करण ाम मसोला ाम सभा – रखवाल गाँव, ॉक डोईवाला, तहसील ऋिषकेश , िजला देहरादून े के अंतग त 07 बड़े हरे पेड़ों का अवैध कटान एवं खलदार के बरसती गदरे पर अित मण के संबंध म संयु सिमित ारा करण पर संयु िनरी ण िदनांक 14.03.2023 को िकया गया, िजसम अिधका रयों की उप थती का िववरण िन ानुसार रहा:- 1. डा. अमृता शमा , तहसीलदार , ऋिषकेश , देहारादून । 2. ी राकेश कंडरी , सहयाक पया वरण अिभयंता , उ राखंड दूषण िनयं ण बोड , देहरादून। 3. ी अिनल िसंह रावत, उप भागीय वनािधकारी , ऋिषकेश। 4. ी अनुभव नौिटयाल, सहयाक अिभयंता, िसचाई खंड , ऋिषकेश। ाम पाली, परगना पछवादून, तहसील , ऋिषकेश (देहारादून) की खतौनी सं ा 56-के भूिम ख.न.

47घ, रकबा 0.0050 हे. भूिम ेणी –s.1, नईपरती के प म दज है एवं खाता सं ा 57 के भूिम ख. न.

47 ग रकबा 0.0080 हे. भूिम कोणी S.3/ बंजर के प म देज है । उ भूिम पर सामुदाियक भवन (61x 51 िफट ) िनमा णाधीन है। संयु सिमित को िनरी ण के दौरान उ थल पर िकसी कार का जल ोत एवं जलधारा नहीं पाया गयी ओर न ही उ भूिम पर वत मान समय म पेड़ों के कटान एवं पातन के संबंध म कोई सा नहीं िमले ह । O.

None had appeared on behalf of the applicant on the previous date and even today none has appeared for the applicant.

No objections to the report of the Joint Committee have been filed by anyone so that there is no reason to doubt correctness thereof.

In view of the observations made by the Joint Committee that there is no evidence regarding cutting of trees and no water body/drain exists in the land where community center is being constructed we are of the opinion that no further action is required to be taken on the present application and the same is disposed of accordingly.

A copy of this order be sent to the applicant by post for information.
