Mr Naveen Rana has sent by post the present letter petition, whichhas been treated and registered as original application, complaining about large scale illegal encroachments in the form of mobile and stationary vending stalls spread all over the bank of River Ganga from Ram Jhula to Janki Jhula at Swargashram, District Pauri Garhwal (Uttarakhand)which are causing pollution of River Ganga.

The vendors have encroached the bathing ghats and eventoilets constructed during Kumbh Mela outside Vanprasth Ashram.

The area has become prone to untoward accidents because of use of highly inflammable fuel by the vendors.

Vide order dated 14.09.2022, this Tribunal constituted a Joint Committee comprising of the representative of Uttarakhand Pollution Control Board (UKPCB),Executive Officer, Municipal Council, Pauri, Garhwaland the District Magistrate, Pauri, Garhwalwith direction to submit its report within one month which period was extended by one month vide order dated 20.12.2022.

583/2022 Naveen Rana Vs State of Uttarakhand & Ors. -3- 4- Jherh eUtq pkSgku] vf/k'kklh vf/kdkjh] uxj iapk;r] LoxkZJe&tkSad] ikSM+h x<+okyA LFkyh; fujh{k.k ds le; Jh uohu jk.kk] ik"kZn] f'kdk;rdrkZ _f"kds'k mifLFkr FksA LFkyh; fujh{k.k esa f'kdk;rdrkZ ds f'kdk;rh i= ds Øe esa fcUnqokj fuEuor fLFkfr ik;h x;h gS] ftlds QksVksxzkQ layXu gSA िशकायती प का िब दु सं ा िशकायत का िववरण थलीय थित 1. रामझूला से गीता भवन की ओर मुड़ते ही िद ी वालों की दुकान के समाने] जोशी ोिवजन ोर] करघा व ालय के सामने तथा गीता भवन पूड़ी िमठाई की दुकान के सामने बेतरतीब ठेिलयां लगी ई ह तथा भारी ग गी ा है। रामझूला से गीताभवन की ओर मुड़ते ए ोिवजन ोर] करघा व ालय के सामने लगभग 2-3 पंजीकृत ठेिलयां चलायमान थित म पाई गई है तथा चलायमान थितम पाई गई हैतथा चलायमान थित म होने के कारण उ थल पर नगर पंचायत किम यों ारा सफाई की जाती है तथा ग गी जैसी कोई थित नहीं पाई गई है । 2. गई है । 2. नाव घाट के ऊपर भी चाय आिद की थायी ठेिलयां/ ॉल लगी यी है] जो भरी गंदगी करते ह । नरी ण के समय नवघाट म चाय कीकोई ठेली लगी नहीं पाई गई। नवघाट के ऊपरी भाग म माग पर एक पंजीकृत ठेली लगी है] उ ठेली संचालक ारा ठेली पर कूड़ादान की व था की गयी है] िजससे उ ठेली से उ ािदत होने वाला अपिश गंगा नदी म नहीं जाता है। 3. नई धम शाला के गेट पर गा म ट के एक कम चारी ारा एक चाय की दुकान ॉल ब त ही बेतरतीब तरीके से लगाकर सड़क के उपर अित मण िकया आ है तथा ब त ादा ग गी फैलाई यी है। नई धम शाला के गेट पर लगाया गया चाय का ॉल सड़क के िकनारेहै।उ ॉल पर स त कूड़ेदान की व था की गई है] िजससे अपिश इधर- ऊधर नहीं फैलता है। 4. ल ी नारायण मंिदर के घाट के दोनों 3 साइड की सीिढ़यों पर करीब 20 ॉल वालों के ारा पूण प से अित मण िकया गया है] जंहा पर भारी ग गी ा है और पूरे घाट को ब कर िदया गया है। इन ठेली वालों के ारा घाट पर ठेली लगाने से गा म म ल ीनारायण मंिदर के समीप लगभग 12 पंजीकृत ॉल है।इस ॉल के कारण गंगाघाट पर आवागमन म िकसी कार की बाधा उ नहीं होती है. उ ठेिलयां गंगा घाट से पया दूरी पर लगी ई है। उ ठेली संचालकों ारा O.

583/2022 Naveen Rana Vs State of Uttarakhand & Ors. -4- मिहलाओं को ान आिद करने म भी ब त िद त होती है तथा इसी आड़ म नहाने वाले याि यों के कपड़े] पस ] जेवर आिद भी चोरी होते रहते है] िजसकी सूचना पुिलस के ारा दज िकये जाने म सदैव आनाकानी की जाती है] िजस कारण यह घटनायऐ रकाड पर नहीं आ पाती। ठेली वालों म अिधकाश लोग बाहरी े ों के है। अपिश हेतु कूड़ादान भी लगाये गये है।उ थल पर सम ठेली संचालक लाईस सधारक है। 5. गीता भवन के सामने लगभग आधी सड़क घेरकर ठेली व ॉल लगाये गये है] जहां ब त ही ादा गंदगी रहती है तथा देखने म भी ब त अिधक बुरा लगता है। गीता भवन नं0-1 के मु ार के सामने वाले माग पर लगभग 2-3 पंजीकृत ठेली संचालक वसाय करते है] िजनके ारा अपिश हेतु कूड़ेदान रखे गये है] इसिलए थलीय िनरी ण के दौरान ग गी जैसी कोई थित नहीं पाई गई। 6. गीता भवन के गेट पर भी ठेली वालों का भारी जमावड़ा रहता है तथा गीता भवन से लेकर भारत साधू समाज बाजार ार होने तक भी सड़क के उपर थाई अित मण हो चुका है] जहां पर ब त ादा ग गी ा रहती है। यहा पर एक ही प रवार ारा कुल 06 ठेिलयां/ ॉल लगाकर अित मण िकया गया है। और यह ठेिलयां ठीक गीता भवन न र -01 के न र -01 के गेट के सामने आधी से ादा सड़क को घेरकर लगाई जाती है। इससे शम नाक थित और कोई नही हो सकती िक अिधकारी भी चुपचाप वहा से िनकल जाते है और उन पर कोई काय वाही नहीं करते है। xhrk Hkou ua0&1 ds eq[; }kj ds lehi okys ekxZ ij 02 iathÑr Bsfy;k¡@LVkWy yxs gSa] ftuds dkj.k ekxZ ij vkokxeu esa dksbZ dfBukbZ LFkyh; fujh{k.k ds nkSjku ugha ik;h x;hA 7. इसके प ात बाजारकोपार करते ही गीता भवन नं र-2 के गेट के सामने पंजाब नेशनल ब क के सामने पर परमाथ िनकेतन घंटाघर के िनकट तथा आगे जानकारी सेतु तक इसी कार ठेली वालों के ारा सड़क पर अित मण कर पूरी की पूरी सड़क पर अित मण िकया गया है। गीता भवन नं0-2 के सामने एवं पंजाब नेशनल ब क गा म के सामने वाले माग लगभग 02-03 पंजीकृत ठेिलयां चलायमान थित म संचािलत होती है। O.

583/2022 Naveen Rana Vs State of Uttarakhand & Ors. -5- 8. गीता भवन न र -03 और वान थ आ म के बीच वाली गली तथा गंगा जी की ओर जाने वाले रा े पर काशी िसंह के ारा बाहर से झोपड़ी तथा अ र प ा िनमा ण कर पूरे का पूरा अित मण कर िलया गया है। गीता भवन नं0-3 एवं वान थ आ म के बीच वाली गली म िकसी भी कार का अित मण नहीं पाया गया।गंगा नदी की ओर जाने वाले माग पर एक अ थाई झोपड़ी बनाकर अित मण िकया गया है। 9. इसी कार वान थ आ म के बाहर पूव म कु मेला ारा लगाए गए शौचालयों पर अितकमण कर उसके ऊपर पूरी की पूरी झोपड़ी बनाकर अित मण कर िलया गया है। यह स ि सरकारी भूिम है] जो िक जानकी पुल रामझूला के मु माग से लगी ई है] िजसमे 02 अ थाई झोपिड़यों का िनमा ण कर सरकारी भूिम पर अित मण िकया गया है। 10. गा म एक अ मह ूण े है और इसम ठेली / ॉल वालों के ारा बेतरतीब ठेिलयां लगाये जाने से पूरे के पूरे े की छिव धूिमल होती है तथा इससे पय टन उ ोग पर भी िवपरीत भाव पड़ रहा है। इस कार की ग गी और ब त ही भ े पन को देखकर पय टक यहां पर ा छिव लेकर जाते ह यह एक िवचारणीय है। नगर पंचायत जौंक े की भौगोिलक थित के अनुसार लगभग 60 ितशत भाग मैदान तथा लगभग 40 ितशत भाग पव तीय है।अिधकांश भूिम िविभ सं थाओं / आ मों के ािम की हैिजनके ारा चारदीवारी की गई है।वत मान प र म सम ठेिलयों] फड़ो] खोमचों का िवके ीकरण िकया जाना आव क है। 11. क है। 11. इस पर अंकुश न लग पाने के कारण यहां लोग आये िदन अपने र ेदारों एव प रवार के लोगों को बुलाकर यंहा नए-नए ॉल थािपत कर रहे है] िजससे िक यह सम ा एक िवकराल प लेती जा रही है। इनम से कई लोगों ारा अवैध शराब तथा अ अवैध मादक पदाथ की अवैध िब ी की सूचना भी समय-समय पर ा होती रहती है तथा इनम से ादातर लोग घरेलू िसल डर का धड़ े से उपयोग करते है ेक ठेली पर एक िसल डर होने के कारण सुर ा की ि से भी अ संवेदनशील एवं खतरनाक थित बनी यी है। हाल ही म जोशी ोिवजन ोर के सामने एक ठेली के िलस डर म आग लगने के कारण दुकान का भी ब त नुकसान होने से बचा. िजसम दुकान मािलक के हाथ भी झुलस गये थे तथा इसी कार राम झूला के िनकट नगर पंचायत ारा अवगत कराया िक समय-समय पर अवैध ठेली संचालकों को हटाने की काय वाही अमल म लाई जाती है. अिधकांश ठेली संचालकों ारा वसाियक गैस िसले रों का उपयोग िकया जाता है।घरेलू गैस िसले र के उपयोग की थित म ज ी / अथ द की काय वाही शासन ारा अमल म लाई जाती है। O.

583/2022 Naveen Rana Vs State of Uttarakhand & Ors. -6- उमाशंकर िद ी वालों के सामने भी िसले र म आग लगने की एक घटना हाल ही म घिटत हो चुकी है] िजससे िकसी भी समय कोई ब त बड़ी दुघ टना हो सकती है] उसके िलये भी स ूण िज ेदारी अिधशासी अिधकारी नगर पंचायत] गा म जौंक की होगी। इन ठेिलयों पर अवैध प से केरोिसन ोव घरेलू गैस िसले रों व चू ों का भी ावसाियक योग िकया जा रहा है] िजसके चलते आगजनी की कुछ घटनाय हो चुकी है। और कभी भी कोई बड़ी दुघ टना हो सकती है। ा हम वाकई िकसी बड़े हादसे का इंतजार कर रहे है?

12. अवगत कराना है िक अित मणका रयों म अिधकांश लोग गा म े के नहीं है] तथा कुछ अिधका रयों के ारा मा ाथ पूित के कारण भारतवष के अ मह पूण पय टक एवं तीथ थल गा म े की छिव को नुकसान प ंचाया जा रहा है। नगर पंचायत गा म जौंक ारा अवगत कराया गया है िक ठेली संचालकों को लाईस स िनयमानुसार स ापन के उपरा ही िनग त िकये जाते है। नगर पंचायत गा म जौंक ारा पा ता पूण करने पर गा म े से इतर अ े के िनवािसयों को भी उ राख फेरी िनयमावली 2016 के ावधानों के अनुसार ठेली संचालन हेतु लाईस स िनग त िकये जा सकते है। 13. ते है। 13. अतः इस अवैध तथा बेतरतीव अितकम को हटा कर इ े वेद िनकेतन आ म के सामने जानकी झूला के िनकट सभी को एक थान पर थान िदया जा सकता है] जो े के थानीय िनवासी है तथा वहां पर इ कोई सम ा भी नहीं होगी। ोंिक जानकी झूला आज एक तम थान है और जहां पर पूरा िदन और देर राि तक लोगों का आवागमन रहता है। इससे इनके वसाय पर कोई ितकूल भाव भी नहीं पड़ेगा तथा े भी साफ सु र हो जायेगा । नगर पंचायत गा म जौंक ारा अवगत कराया गया है िक उ राख फेरी िनयमावली 2016 के अनुसार गिठत नगर फेरी सिमित की बैठक िदनांक 15.11.2022 को गैर ितब त े (Vending Zone) का िनधा रण िकया गया है।नगर फेरी सिमित ारा गैर ितब त फेरी े म यथा आव कता माग से ठेली / फड़ो को िश िकये जाने की काय वाही भी यथाशी अमल म लाई जायेगी। O.

That in compliance of the above mentioned directions passed by this Hon'ble Tribunal the subject-wise report in Tabular form by way of affidavit is being furnished as follows: Sr.

Details of Complaint Status of the Site 1 There is lot of garbage andstreet-vendors standing in bad- manner on the turning of Geeta Bhawan from There is no garbage found on the turn of Geeta Bhawan from Ramjhula on front side of shop of Delhiwala, Joshi provision store and Kargha Vatralaya.

583/2022 Naveen Rana Vs State of Uttarakhand & Ors. -8- Ramjhula, and on front side of shop ofDelhiwalaJoshi provision store and Kargha Vatralaya There are 2-3 registered vendors in moving condition, which were found and sweepers of municipality are regularly sweeping the spot in question 2 There are tea-stalls and thelies installed on the upper side of Nav-Ghat and they spread lot of garbage At the time of inspection, no tea-stall was found on the in Nav-Ghat.

On the upper side of Nav-Ghat one registered- tea vendor was standing, the vendor has installed the dustbin, so that garbage generated from the stall does not go to river Ganga.

3 On the gate of new Dharamshala, one tea stall is installed in very bad-manner by encroaching the roadby one employee of Swargashram trust and a lot of garbage has been spread.

There is tea stall installed on the one side of road on the gate of newDharamshala,the above concerned tea-vendor has installed the dustbin, and, therefore, no garbage is spreading. spreading.

4 On both sides of Laxmi Narayan Temple, complete encroachment hasbeen done on the stairs by about 20 vendors by installing the stalls, lot of garbage is available and the Ghat has been completely closed, because of the same, the ladies are facing lot of problem in taking bath, in the guise of the same, the clothes, purses, jewelry etc. of the tourists are stolen at 'the time of bathing, the police ignore to registered report of the same, therefore, these incidents don't came into light.

Mostly vendors are from outside.

There are about 12 registered stalls in Swargashram nearby Laxmi Narayan Temple, but no problem is created in moving on the river-bed because of 'these stalls, since the above stalls are installed at sufficient distance from the river bed, the above vendors have already installed the dustbin, all the vendors are licence-holders of nagar Panchayat.

5 On the opposite sideof Geeta Bhawan, the thelies and stalls areinstalledby encroaching half of road, there is lot On the opposite road of main gate No.1 of Geeta Bhawan, about 2-3 registered thelies (vendors) are doing their livelihood, they have already installed the dustbins, O.

6 There is lot of gathering by Theli vendorson the gate of Geeta Bhawan and permanentencroachme nt has been done on the road starting from Geeta Bhawan to Saadhu Samaj Bazar, there is lot of garbage available.

There is encroachment done by one family by installing total 06 Thelies/stalls, and these thelies are installed on the exact opposite side of gate no.1 of Geeta Bhawan by encroaching half of road, there are in very shameful position, when the officers crosses this side they also remain keep quite and don't take any action On the opposite road of main gate No. n gate No.1 of Geeta Bhawan, about 2-3 registered thelies (vendors) are doing there livelihood, they already installed the dustbins, therefore, at the time of spot inspection, no garbage were found.

7 By crossing the above market, the whole road has been encroached by Street- vendors on the gate No.2 of Geeta Bhawan opposite side of Punjab national Bank nearby ParmarthNiketantillJa nki Bridge.

There are 2-3 registered Street- vendors installed in moving condition on the Gate No.2 of Geeta Bhawan and Punjab National Bank opposite side road of Swargashram.

8 Between street ofGeetaBhawanNo.3a ndVaanprasthAshram on the side of river Ganga, hut is installed and inside permanentconstructio n has been done by Kashi Singh and encroached is done on whole side.

No type of encroachment is found between street of Geeta Bhawan No.3 and Vaanprasth Ashram, there is encroachment done by installing a temporary hut on the road to river Ganga, which has been removed by the local administration.

9 Like this there are encroachments This is government land, the same is adjoining to main road O.

583/2022 Naveen Rana Vs State of Uttarakhand & Ors. -10- doneon thetoiletsestabli shed by KumbhMela in east of Vaanprasth Ashram by installing the huts. of JankiPul- Ram Jhula and there is encroachment has been done by installing 2 temporary huts on the government land.

In this regard notices have been issued to the encroachers and the temporary huts shall be removed soon.

10 There is very important area of Swargashram, the image of the same is not shown good by blocking the area installing the Thelies/ stalls in bad manner and it create a bad picture on the tourism industry, therefore, it has to be considered that the garbage create bad picture in the mind of tourist.

According to the area of Nagar Panchayat, Jaunk 60 percent area of Jaunk is plain and about 40 percent area is hilly, most of the land is in occupation of different organizations/ ashrams, they covered their area by construct constructing the boundary walls, so therefore, the decentralization of all Thelies, Stalls and Khomchas etc. is necessary.

11 Due to no restrain on same, new stalls are establishing daily by the persons by callingtheir relativesand Family persons, this problem is increasing day by day.

The information about selling of illegal liquor and other illegal drugs is received from time to time and most of the persons are using domestic cylinder openly, it is very sensitive in view of security, having a cylinder on the stall, recently an incident of fire have occurred opposite side of Joshi Provision Store and a big damages had not happened, in that incident the hands of shop-owner were scorched and like this incidents happened in Ramjhula opposite This has been informed by Nagar Panchayat, that the action for' dismantling the illegal vendors is done from time to time, most of the vendors are using commercial Gas cylinders, the action of confiscation/ imposing fine in case of using of domestic cylinder.

583/2022 Naveen Rana Vs State of Uttarakhand & Ors. -11- side of Umashankar Delhiwala due to fire in cylinder, there may be a big incident, if this type of incident tooks place, then for the same Executive Officer,NagarPanchay at, SwargashramJaunk will be responsible.

The thelies vendors are using kerosene stoves and domestic gas cylinder and stoves, due to the same some fire incident had took place, and they can be happen in future, are we waiting for a big incident?
