In continuation of the previous order dated 01.09.2023, we are passing the present order, in which in para no.4, we had directed the applicant to disclose as to why the prayer no.(i) had not become infructuous and had also made it clear that in case he would not be able to do the same, this Tribunal would be compelled to dismiss this application.

Today, we again enquired from the learned counsel for applicant with respect to the said prayer, he could not give any appropriate response and after having heard for certain period, he gave consent to Page 2 of 2 withdraw this application and sought liberty that he may be permitted to place before this Tribunal a better worded petition with appropriate relief along-with the relevant provisions of law cited therein.

In view of the prayer made by the learned counsel for applicant, we dismiss this application as withdrawn with liberty as prayer for.
