We are passing this order in continuation to the earlier orders dated 18.04.2023, 13.07.2023, 08.08.2023, 18.10.2023, 10.09.2024 and 21.04.2025.

By our previous order dated 21.04.2025, we had granted one week’s time to learned counsel for the execution applicants to file rejoinder affidavit to the reply filed by Respondent No.12 to I.A.

No.17/2024 (WZ), which was moved for personal compensation by the applicants, but no such rejoinder affidavit has been filed till date despite approximately two & half months’ time having lapsed.

In this regard, learned counsel for the applicants submits that because of being busy due to personal difficulty, he could not file the same and seeks additional one week’s time to file the same.

In regard to the above, we find that already an affidavit dated 28.01.2024 of Mr.

Mahesh Hastimal Gandhi has been submitted by learned counsel for Respondent No.12 with his reply affidavit dated 25.04.2025 and that he has informed us that Respondent No.12 had approached Mr.

Mahesh Hastimal Gandhi, from whom the bills were produced by the applicants in support of the said I.A. and that the said person has stated that the said bills are fake and were never issued by him.

Learned counsel for the applicants submits that the said bills were issued by the employee of Mr.

Mahesh Hastimal Gandhi.

We fail to understand as to how the owner is refusing the said kind of bills to have been issued by the employee thereof and how the employee could have power to issue such kind of receipts regarding sale of crops.

Therefore, we do not deem it appropriate to grant any further time to learned counsel for the applicants in this regard and also do not find any substance in the averment made by learned counsel for the applicants on the said I.A.

Accordingly, we dismiss I.A.

NO.17 OF 2024 (WZ).

Since the issue involved in the present application already pending consideration before the Hon'ble Supreme Court, we also dispose of the present Execution Application accordingly.

Pending I.A. also stands disposed of.
