The applicant filed present Execution Application No.03/2022/EZ for execution of order dated 17.08.2021 passed by this Tribunal in Original Application No.
129/2016/EZ alleging non-compliance with the same.

Affidavit dated 10.02.2026 has been filed by respondent no.
4 which is taken on record.

In the course of hearing on 09.05.2023, it was pointed out that order dated 06.04.2023 passed by this Tribunal in Execution Application No.03/2022/EZ in Original Application No.129/2016/EZ was challenged by filing Writ Petition (C) No.14057 of 2023 State of Odisha and others Vs.
Wildlife Society of Orissa (Elephant Corridors) and Another was filed before the Hon’ble High Court of Orissa at Cuttack in which a stay order was passed.
Thereafter, affidavit dated 04.10.2023 was filed by Respondent No.4, Principal Chief Conservator of Forests and Chief 2 Wildlife Warden, Government of Odisha mentioning about filing of W.P. (C) No.14706 of 2022 Gita Rout and Another Vs.
State of Odisha and Others.
On 20.07.2024 this Tribunal was informed that W.P. (C) No.14706 of 2022 Gita Rout and Another Vs.
State of Odisha and Others has been tagged with W.P. (C) No.
14057 of 2023 State of Odisha and others Vs.
Wildlife Society of Orissa (Elephant Corridors) and Another.

Both the above said Writ Petitions are still pending before the Hon’ble High Court of Orissa at Cuttack.

It has been conceded by the Learned Counsels for the parties that the decision of the above said Writ Petitions will have a direct bearing on the present Execution Application.

In these facts and circumstances of the case, the present Execution Application is disposed of with liberty to the applicant to file fresh Execution Application, after decision of the above said Writ Petitions and in accordance with the decision thereof, as the case may be.
