The applicant are the resident of Mahindra Square Multistory Building Bawadiakalan.

It is stated that when they purchase this flat it was told by the builder that the land in front of the site is a open land of the government which will be developed as a foot path or tree plantation as a green cover.

In due course of time the former builder raised certain constructions.

The contention of the applicant are that since the builder who sold the plot/flat to the applicant told that the open land is green belt and on basis of that they purchase the land/flat.

The issue as narrated by the applicant are their personal property dispute and there is nothing covered under Schedule-I of the National Green Tribunal Act to intervene by the Tribunal.

The applicant have alternate remedy to move before appropriate forum for redressal of the grievances for easementary right, ownership or the possession of the land in question.
