ORDER 1.
In this original application, the applicant has questioned the auctioned notices dated 17.05.2023 and 11.09.2023 issued by the District Magistrate, Banda on mainly two grounds, firstly the District Survey Report (DSR) prepared for the area concerned on 23.11.2017 has expired after five years in 2022 and no fresh DSR has been prepared and that no replenishment study has been done and that the Magistrate has added replenishment quantity of minerals with the quantity at pre- monsoon level and has issued the advertisement.

On the same issue in respect of the same area questioning the same advertisement another original application bearing OA 747/2023 Raj Kumar Vs.
Ministry of Environment, Forests and Climate Change & Ors. has been filed by the same counsel though at the instance of the different applicant.
In that original application the tribunal on 02.01.2024 has issued notice to the respondents.

Thus we do not find any reason to entertain another OA on the same issue and on the same grounds.

Hence, the original application is dismissed, however with liberty to the applicant to file an appropriate application in the pending OA.
