In this original application, grievance has been raised about massive dumping of garbage/solid waste in the basement of Tower G- 8/building of Resident No.

4 in Nirala Greenshire situated in Greater Noida West, District Gautam Buddha Nagar, Uttar Pradesh.

The grievance is that such a garbage dump is causing extreme environmental degradation and harm to the health of local residents and the same is being done in violation of the Solid Waste Management Rules, 2016 and other norms relating to preservation of environment.

It has been disclosed that garbage/solid waste is being collected by the garbage man door to door everyday from the residents of the society and it is dumped in the basement of Tower G-8 unscientifically and unhygienically.

The submission of Counsel for the Applicant is that though various complaints have been made to different authorities, but till now no remedial action has been taken.

On perusal of the OA we find that though certain receipts relating to imposing of fine have been placed on record but a copy of the complaint to the competent authority has not been placed on record.

In the circumstances of the case, we are of the opinion that the Applicant should first make a proper complaint to the Chief Executive Officer of Greater Noida Authority, District Gautam Buddha Nagar and if such a complaint is made by the Applicant, the Greater Noida Authority will duly consider the said complaint and take appropriate remedial action in accordance with law within a period of two months from nths from the date of receipt of the said complaint.

The Greater Noida Authority, after completing remedial action, will submit the report before the Registrar General of this Tribunal by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF.

If found necessary, the matter will be listed before the Bench for consideration.

The OA is accordingly disposed of.

A copy of this order be forwarded to the Chief Executive Officer, Greater Noida Authority, District Gautam Buddha Nagar, UP by e-mail for compliance.
