This application seeks modification of the direction in the order dated 23.08.2023 whereby Original Application No.

82/2023(CZ) was finally disposed of, stating that as observed in para 26, no undertaking was given by the Learned Counsel.

In para 4 of M.A.

No.08/2023(CZ), it is said that no undertaking was given on behalf of respondent 5 and the same has been wrongly mentioned in the order and the affidavit accompanied in this application says that application contains averments based on the instruction of the Counsel.

An affidavit by Learned Counsel has also been placed on record.

It is admitted that applicant was not present and whatever transpired in the Court, on that basis, the order was passed on 2 23.08.2023.

The stand now taken is an afterthought.

We do not find any reason to accept the changed stand taken in this M.A.

Moreover, the prayer amounts to review of the order and no M.A. is maintainable.

The application is accordingly rejected.
