In compliance with our previous order dated 18.10.2023 read with order dated 21.11.2023, respondent Nos.1 to 3 - PMC has submitted its factual report dated 23.11.2023 today wherein it is stated that the PMC has planned to develop 24 meter wide road as per sanctioned Development Plan of 2017 for Pune city from main Bhugaon road to Marigold Banquet Hall, out of which 12 meters wide road has already been developed by asphalting on the actual site, while remaining 12 meter wide road is yet to be developed, which will involve felling of trees.

A proposal of the trees which are likely to be affected by the development [NPJ] Page 2 of 2 of road was made public and objections were invited regarding which only the applicant had raised objections.

As per the aforesaid factual report, the applicant had asked for removal of pillar/tower on the existing road on Bavdhan (Budruk) which is constructed for beatification near Ram River before removing the affected trees.

The said suggestion has been accepted by respondent Nos.1 and 3 – PMC and now the applicant has no objection to the trees being felled.

It is also made clear in the said report that the PMC is planning to construct a culvert/bridge over Ram river which is in process and for construction of the same, the pillar/tower will have to be removed.

Till date, no trees have been felled.

The applicant is present in person and is satisfied with the factual report submitted by respondent Nos.1 to 3 – PMC and submits that he has no objection now since the PMC has decided to construct a bridge/culvert over Ram river, it would be useless to cut the trees without removal of tower/pillar.

In view of above report filed by respondent Nos.1 to 3 – PMC, we find that nothing remains to be decided in this application.

We may make it clear that whenever trees are required to be removed, appropriate permission shall be taken by PMC from the Tree Authority prior to cutting of the trees.

With these observations and direction, the Original Applications are disposed of.
