This review application has been filed by original applicant Shri Umesh Kumar Singh, seeking review of our judgment dated 17.08.2023 passed in Original Application (hereinafter referred to as ‘OA’) 76/2023 (CZ) whereby OA was dismissed.

Learned Counsel appearing for review applicant has again prayed that Tribunal should constitute a Committee comprising of Commissioners, Collectors and review applicant to take samples and submit report to Tribunal with chemical analysis.

The reasons for not accepting the review applicant’s request that it should be allowed/permitted to inspect the industrial premises and submit report, have already been given in our order and no manifest error in the judgment has been pointed out despite repeated queries by this Tribunal.

Review application is not an occasion to allow review applicant an opportunity to re-argue the matter.

It is not within the scope of review.

Review lie only when a glaring error in the judgment is pointed out and not to give an opportunity to the applicant to re-argue the matter.

We, therefore, find no merit in the application, hence dismissed.
