This Original Application has been registered on the basis of the letter petition sent by one Sugandha Sharma with the allegation that the National Highways Authority of India is constructing a four-lane highway from Kiratpur to Manali and Pathankot to Mandi in flood prone area specially close to the Beas river.

There are certain other allegations in the letter petition like targeting existing building for demolition instead of utilizing the effective plan etc. which are not directly relating to the issues concerning environment.

Therefore, on the limited issue relating to construction on the flood plain area, we deem it proper to call for a report from a joint Committee comprising of the Executive Engineer, In-charge of NHAI, Officer deputed by Member Secretary, CPCB and the Member Secretary, HPPCB.

The Member Secretary, HPPCB will act as a nodal agency.

The Committee will examine the issue and submit the report before the Registrar General of this Tribunal within eight weeks by e-mail at [email protected] preferably in the form of searchable PDF/ OCR Support PDF and not in 2 the form of Image PDF.

If found necessary, the matter may be listed for the Court for consideration.
