This appeal is directed against the order dated 14.07.2023 passed by the Respondent-UPPCB imposing the environmental compensation of Rs.87,10,000/-.

There is a delay of seven days in filing this appeal.

Having heard the Learned Counsels for the parties and perusal of the application, it is noticed that the delay is properly explained.

Hence, the case is made out to allow the prayer for condoning the same.

No.735/2023 is allowed and delay in filing the appeal is condoned.

No.736/2023 has been filed seeking exemption from filing typed copies of illegible/dim documents.

On due consideration, the IA is allowed and exemption is granted subject to the condition that the 2 Counsel for the applicant will provide legible copies of documents on which he wants to place reliance upon during the course of argument.

The Learned Counsel for the respondent submits that the original record is available with him.

He is directed to produce a photocopy of the original record on the next date.

In the meanwhile, it will also be opened to Counsel for the respondent to file reply within four weeks thereafter rejoinder, if any, be filed within two weeks.

List the matter on 12.01.2024.
