Original Application No.
150/2023 was registered in suo motu exercise of power by the Tribunal on the basis of the media report relating to death of two persons and injuries to other two in an explosion in Ven Petrochem & Pharma India Pvt.
Ltd. (Project Proponent -PP), Valsad, Gujarat on 28.02.2023.

The Tribunal by a detailed order dated 15.03.2023 had taken note of the scope of the matter and considered the issue of payment of compensation and noted that status of compliance of Manufacture, Storage and Import of Hazardous Chemical Rules, 1989 was not verified and the precise cause of incident and measures required to be adopted to prevent such incidents in future were required to be ascertained.
Accordingly, OA was disposed of by forming a joint Committee to suggest measures in this regard.
There was a further direction to the joint Committee to file the report before the Registrar General of this Tribunal 2 and to place the matter before the Bench for further direction, if found necessary.

On the basis of the report so filed by the joint Committee, present MA No.
83/2023 has been registered.
The report reflects non-compliance of the environmental laws and lapses on the part of the unit concerned.

Since the matter relates to the Western Zone Bench of the Tribunal, therefore, it is transferred to said bench for appropriate further action in accordance with law.
The Registry is directed to transfer the records of this matter to the Western Zone Bench, Pune.

M.A. is accordingly disposed of for re-registration before the Western Zone Bench, Pune.
