Arvind Kumar Advocate for UPPCB. (Through VC) Application is registered based on a letter petition received by E-mail ORDER 1.

The original application, registered on the basis of the letter petition, raises the issue of operation of the three brick kilns namely M/s Mahalaxmi Int Udyod, Luherpur Vallipur Village, M/s Shivam Brickfield Ramnagar and M/s A.B.R Int Bhatta Rasulpur, District Sultanpur, Uttar Pradesh in violation of environmental norms, without CTE and CTO from the UPPCB.

On the direction of the Tribunal the Joint Committee was constituted on 01.08.2023 and report has been filed on 12.01.2024 disclosing as under:- “X X X X 2 3.

Above said Joint Committee has inspected the all 03 Brick Kilns on 30.12.2023, in which 01 Brick Kilns M/s Mahalaxmi Ent Bhatta, Village-Dariyapur (Luharepur), Post-Vallipur, District-Sultanpur was found not in operation and having valid CTO under Air/Water Act which is valid up to 31.07.2025.

Other 02 Brick Kilns M/s Maa Vaishno Brick Field (Shri Shivam Jaisawal, Partner), Village Ramnagar, Post-Saraiya Mafi, District-Sultanpur and M/s Adarsh Ent Udyog (ABF), Village- Rasulpur, Post-Vallipur, District-Sultanpur were found closed in compliance of the closure order issued by UPPCB.

A copy of the all Joint Committee Inspection Reports dated 04.01.2024 along with photograph are being attached as Annexure No.-2, 3 & 4 to this Response…..” 3. nse…..” 3.

As per the said report second and third brickkiln have been closed down and only first brick kiln M/s Mahalaxmi Int Udyod, Luherpur Vallipur Village has the CTO valid upto 31.07.2025.

At the time of inspection, the same was not found to be operational.

Hence, the Joint Committee is directed to carry out the fresh inspection of M/s Mahalaxmi Int Udyod, Luherpur Vallipur Village in the first week of February, 2024 and file fresh report before the Registrar General of the Tribunal.

If found necessary the matter will be listed for consideration before the bench.
