SENTHIL VEL, EXPERT MEMBER Application is registered based on a letter petition received by E-mail ORDER 1.

Ms.

Gunjan Mittal has sent the present letter petition which has been treated and registered as Original Application complaining that previously she made a complaint against Harish Mittal and Saurav Mittal who were running Mittal Car Scanning workshop in ground floor of Premises No.

251A of building near Chetan Complex Dilshad Garden, Shahdara, Delhi.

Despite action taken by the authorities, they continue to operate their business illegally by using diesel generators causing more pollution in the area.

416/2022, Gunjan Mittal vs.

Govt. of NCT of Delhi was filed by the applicant which was disposed of by this Tribunal vide order dated 22.11.2022.

The relevant part of order dated 22.11.2022 reads as under:- “X X X X 9.

In the present case, as per the material on record the project proponent M/s.

Mittal Car Scanning was engaged in the activity of car repairing without washing.

The activity was being carried 2 out without the CTE & CTO from DPCC.

One borewell was also installed on the site.

The SDM (Shahdara) issued sealing order with regard to borewell and also imposed penalty of Rs.

50,000/- under section 5 of the Environment (Protection) Act, 1986.

The electricity connection to the unit has been disconnected by the BSES.

The DPCC has issued show cause notice to respondent no.

5 for imposing environmental damages compensation.

The concerned authorities may take action against respondent no.

5 strictly in accordance with law and respondent no.

5 may also avail his remedies against action so taken in accordance with law…..” 3. law…..” 3.

In view of observations made/directions already issued by this Tribunal vide order dated 22.11.2022, the Delhi Pollution Control Committee (DPCC) is directed to look into the averments made in the application and take appropriate remedial action in accordance with law and ensure that no such unit is carried on in violation of the environmental norms.

The application is disposed of accordingly.
