SENTHIL VEL, EXPERT MEMBER Application is registered based on a letter petition received by E-mail ORDER 1.

The grievance of the applicant is against establishment of dumping ground in the residential area near River Gaula by Municipal Committee, Kichha, District Udham Singh Nagar, Uttarakhand.

The applicant has submitted that Municipal Committee, Kichha, District Udham Singh Nagar, Uttarakhand had advertised for purchase of 5 acres of land for establishment of dumping ground in response to which, Santosh Kumar son of Late Shri Mahender Singh has offered to sell his land.

The garbage collected from Village Siraulikalan and adjoining villages will be dumped in the dumping ground which will lead to environmental pollution, emit foul smell and affect the residents of locality and livestock and will also contaminate the water of river Gaula.

The grievances raised in the application can be redressed by a direction to a Joint Committee of representatives of the concerned 2 statutory authorities to ensure compliance with statutory provisions, environmental rules and directions given by the Hon’ble Supreme Court and this Tribunal regarding establishment of municipal garbage processing and sanitary landfill site.

Accordingly, we constitute a Joint Committee comprising of Regional Officer, Uttarakhand Environment Protection and Pollution Control Board (UEPPCB), Executive Officer, Municipal Committee, Kichha and District Magistrate(DM), Udham Singh Nagar and direct the same to meet within two weeks, look into the grievances of the applicant, verify the factual position and take appropriate remedial action within one month in compliance with statutory provisions, environmental norm ental norms and directions given by Hon’ble Supreme Court and this.

The UEPPCB will be the nodal agency for coordination and compliance.

Factual and Action taken Report may be submitted within three months by e-mail at [email protected] preferably in the form of searchable PDF/OCR Supported PDF and not in the form of Image PDF, before the Ld.

Registrar General, National Green Tribunal, Principal Bench, New Delhi who may, if so considered to be necessary, direct the matter to be listed before this Bench for further orders.

The application is disposed of accordingly.

A copy of this order, along with a copy of the application and documents attached with the same, be forwarded to the Member Secretary, UEPPCB, Executive Officer, Municipal Committee, Kichha and DM, Udham Singh Nagar by e-mail for requisite compliance.
