    Case is called for hearing on admission on 23.09.2025. Petitioner counsel Sri. Aditya Narayan for Saakshya Law present, made submissions for grant of single application for standing clearance under STOA for their power plant having a capacity of 80.8 MW connected to one interconnection point having common evacuation scheme instead of seeking seven applications for issue of standing clearances. Further, submits that since Respondent No.1(KPTCL) refused to grant the same, the petitioner had filed petition No. 223/MP/2023 before the Hon’ble CERC. The CERC in its order dated 28.07.2023 directed the Respondent No.1 herein to grant clearance, based on which respondent-KPTCL granted standing clearance to the petitioner from August, 2023. Further, the counsel submits that Hon’ble CERC while disposing the said petition on 07.07.2025 observed that the issue involved in the case, i.e. grant of standing clearance to the Petitioner to use of the intra-State transmission network of the KPTCL, is related to the intra-State transmission network in terms of Section 86 of the Act, the issue under this Petition falls under the jurisdiction of the State Commission. Therefore, the Petitioner was directed to approach the concerned State Commission for adjudication of the issues under this Petition. Further, the petitioner counsel submits that Respondent-KPTCL had already granted standing clearance for STOA to the petitioner on the basis of single application in the past without insisting upon different application for each group and prays to continue the interim order dated 28.07.2023 granted by Hon’ble CERC vide Annexure-AB and to admit the petition. Commission heard the petitioner counsel, noted the submissions, admitted the petition. Further, on perusal of Annexure-AB, the Commission felt that interim protection is needs to be issued to protect the interest of the petitioner as ordered by the Hon’ble CERC in it order dated 28.07.2023 in petition No. 223/MP/2023 before the Hon’ble CERC. Hence, the Commission is of the opinion that the interim relief granted by the Hon’ble CERC in it order dated 28.07.2023 shall be deemed to be an interim order passed by this Commission today till further orders. The registry is detected to issue notice to the respondents. Call on 25.11.2025.
