Case called for further hearing on maintainability and admission on 06.05.2025. Counsel for petitioner Sri. Sumath K. Gowda for Precinct Legal and Officer Smt. Harini, Executive Engineer, Elecl., (RA), BESCOM present, submits that application for amendment of petition is filed in the registry on 05.05.2025. Further, filed a memo dated 06.05.2025 for treating the petition as Review petition and prays to take both on record and to pass necessary orders. Commission heard the counsel and officers, perused and noted the contents of IA and memo. During the hearing the Commission noted that neither in the original petition or in the amendment application, the petitioners have indicated about the avenues available to the petitioners to fill up revenue gap, if the tariff in respect of LT-4(a) is reduced as prayed. At this stage counsel for the petitioners prays for time to come up with a comprehensive proposal for reduction of LT-4(a) Tariff. It is further, represented by the counsel for the petitioner to keep the present amendment application pending till the next date of hearing. Commission noted the submissions of petitioners’ counsel and adjourned the case with a direction to the registry to register this petition as a review petition and provide separate number and to list this matter after due compliance.

Case called for hearing on maintainability and admission on 28.04.2025. Hon’ble Advocate General, GoK Sri. K. Shashikiran Shetty appeared for petitioners’ consel Sri. Shahbaaz Husain for Precinct Legal, made submissions for Review/modification/amendment of the Tariff Order dated 27.03.2025 passed by the Commission placing reliance on Sections 62(4), 94(2), 94(1) (f) read with Regulation 8 of the KERC (General and Conduct of Proceedings) Regulations, 2000 to reduce the Tariff determined under LT-4(a) category and prays to admit the petition. The Learned Advocate General made submissions to reduce the Tariff determined under LT -4(a) category and increase the tariff for other category like industry and Commercial. Commission heard the learned Advocate General, noted the submissions, perused the petition with prayer and noted that no comprehensive proposal with sufficient grounds is forthcoming in the present petition. It is seen that the main prayer prays for reduction in Tariff for LT-4(a) category only, whereas the interim relief prays for staying the entire Tariff Order. At this stage learned Advocate General fairly submitted that interim relief sought cannot cross the boundaries of the main relief sought and as such there is a need to make necessary amendment to the petition to bring more clarity and prays for time till 02.05.2025 to file appropriate amendment application. Commission granted time pending decision on maintainability and admission of the petition. Call on 06.05.2025 at 11.00am.
