  Case called for hearing on admission on 04.03.2025. Counsel Smt. Poonam Patil present, made submissions for grant of NoC for Open Access from the Respondent for Wheeling and Banking after the expiry of PPA on 31.03.2025 as the petitioner is not willing to renew the PPA and prays for directions. Respondent counsel Ms. Stephania Pinto for Precinct Legal present, made submissions on the merits of the case, submits that statement of objections is filed in the registry on 03.03.2025 with a copy to the petitioner. Commission heard both the counsels, noted the submissions and perused the documents. It is clear from the materials available on record that the petitioner has already filed application for OA and as such the said prayer need to be considered by the authorities concerned as per KERC (Terms and Conditions for Open Access) Regulations, 2004. That being the case at present, there is no need to give any directions to respondent as prayed by the petitioner. Hence, the present petition is disposed of in terms of provisions of KERC (Terms and Conditions for Open Access) Regulations, 2004 and amendment from time to time.

  Counsel Smt. Poonam patil present before the Commission on 28.01.2025 and submitted that the petitioner has filed original petition before the Commission on 27.01.2025 along with memo dated 28.01.2025 to hear the matter in view of urgency. The petitioner has prayed to set aside the communication dated 21.01.2025 issued by Respondent BESCOM and prays for issue of NoC to the petitioner for wheeling and Banking with effect from 31.03.2025 since the PPA is coming to an end on 31.03.2025. Commission heard the counsel, pending admission of the petition directed the registry to issue notice to the Respondent. Call on 04.03.2025.
