Case called for hearing on admission on 12.11.2024. Counsel for petitioner Sri. Shahbaaz Husain for Precinct Legal present, submits that consequent to the amendment to the Karnataka Electricity Reforms (Transfer of Undertakings of KPTCL and its personnel to Electricity Distribution and Retail Supply Companies) Rules, 2002 on 31.12.2022, no order has been issued by Government for collecting the Government portion of pension contribution through tariff. However, in anticipation of G.O. pursuant to amendment of Rules & in the light of the Hon’ble High Court order dated 25.03.2024, the present review petition is filed and prays to admit the petition. Commission heard the counsel and noted the submissions. Commission is of the considered view that in the absence of relevant G.O. the petitioner cannot file for collection of the Government portion of pension through Tariff. Consequently, there is no case/ground for admission of the present review petition. Petitioner counsel prays for liberty to file appropriate petition after receipt of relevant G.O. and prays to file memo in this regard. Petitioner granted liberty to file memo in the registry. The review petition is disposed off as not maintainable for the reasons mentioned above.

Case called for admission on 22.10.2024. Counsel Sri. Shahbaaz Husain for Precinct Legal appeared for petitioner, made submissions for Review of Tariff Order 2024 dated 28.02.2024 to allow the petitioner to recover the Government portion of Pension and Gratuity contribution through Transmission Tariff in the back ground of the orders of Hon’ble High Court of Karnataka dated 25.03.2024 vide W.P. No. 4010/2023 (GM-KEB) and prays time to place additional documents and to make submissions. The Counsel further submits that IA for condonation of delay dated 05.10.2024 is filed duly explaining the reasons for delay and prays to condone the same. Commission heard the counsel, noted the submissions of the counsel. Commission directed the petitioner to file the Government Order for collecting the Government portion of Pension Contribution through Tariff pursuant to the Amendment of Rules. Granted time to file documents pending admission of the case and IA for condonation of delay. Call on 12.11.2024.
