Poonam Patil Advocate for Petitioner present and filed memo for withdrawal of the petition with a liberty to file a fresh petition and prayed for refund of court fee in terms of Clause 3 iv of KERC fee Regulations, 2016.Commission heard the Counsel perused the memo, taken the memo on record and liberty is given to the petitioner to file fresh petition on the same cause of action. Meanwhile, it is noticed through registry that petitioner has filed this petition through e-filing, the same is numbered as OP No. 16/2024 and paid court fee of Rs. 25000. The registry had raised objections on payment of deficit court fee and asked to pay Rs. 25,85,106/- on the claim made at Annexure-N. Further, it is ordered and directed the office to refund of Rs. 12500 i.e. 50 per of the amount out of Rs. 25000/- to the petitioner in terms of Clause 3 iv of KERC fee Regulations, 2016. Accordingly, the petition is disposed off as withdrawn, with liberty to file a fresh petition.
