SUJATHA WRIT PETITION NO.18678 OF 2023 ORDER: The present Writ Petition came to be filed under Article 226 of the Constitution of India, seeking to declare the action of the respondent authorities in not considering the request of the petitioner seeking transfer made by way of representation dated 14.06.2023, despite the petitioner has made transfer application, Application ID 7046736 during the relaxation of the ban period issued in G.O.Ms.No.71, dated 17.05.2023 without any specific reasons as illegal unconstitutional and violative of principles of natural justice; consequently direct the respondent authorities to consider the representation dated 14.06.2023, duly transferring the petitioner as per the Transfer rules in vogue G.O.Ms.No.71, dated 17.05.2023.

Heard Sri Jada Sravan Kumar, learned counsel for the petitioner and learned Government Pleader for Services –III appearing for the respondents.

Perused the material placed on record.

The brief facts of the case are that, the petitioner is working as Secondary Grade Teacher in MPUP School in MarlaMadiki village, 2 Holagunda Mandal, Kurnool District, who was initially appointed in the said category of post on 13.11.2000.

The petitioner has been working in the said station from 28.07.2022.

The Government of Andhra Pradesh issued orders in G.O.Ms.No.71 Fin (HR-I-PLG & policy) Department dated 17.05.2023, effecting the teachers transfers for all categories, in which the teachers with zero Service are also eligible to apply for transfers lifting the ban on the transfers during the period from 22.05.2023 to 31.05.2023.

The petitioner has submitted the transfer application No.7046736, which is kept pending for consideration before the respondent authorities.

On 10.06.2023 and again on 14.06. on 14.06.2023 the petitioner has made representations to the Commissioner of School Education, Ibrahimpatnam/2nd respondent requesting to resume the petitioner’s name in the list of promotions and transfers and the same were kept pending for consideration.

However, till date the 2nd respondent did not consider the same.

In view of the same, instead of going into the merits of the case, this Court feels it appropriate to dispose of the Writ Petition by directing the 2nd respondent, to consider the representation dated 14.06.2023 being the latest one and pass appropriate orders in 3 accordance with the existing rules, within a period of two (02) weeks from the date of receipt of a copy of the order.

Accordingly, Writ Petition is disposed of.

There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall also stand closed. ______________________ SMT.
