3723 OF 2023 ORDER: The petitioners are accused Nos.

1 and 3 in crime No.

77 of 2023 of Hindupur II Town Police Station, Sri Sathya Sai District.

They filed the present petition seeking anticipatory bail.

The said crime was registered for the offence punishable under Section 34 (a) of A.P.

Excise Act.

Heard learned counsel for the petitioners and learned Special Assistant Public Prosecutor.

As seen from the averments made in the F.I.R., the petitioners were found in possession of 24 old Tavern whisky packets of each 180 ml. and 192 Hyward whisky packets of each 90 ml.

The contraband was seized by police under a cover of panchanama.

Be that as it may, as the alleged offence is under Section 34 (a) of A.P.

Excise Act, this Court is inclined to grant anticipatory 2 bail to the petitioners-accused Nos.

1 and 3 with certain conditions.

The petitioners-accused Nos.

1 and 3 are directed to surrender before the Station House Officer, Hindupur II Town Police Station, on or before 28-06-2023.

On such surrender, the Station House Officer, Hindupur II Town Police Station, is directed to enlarge the petitioners-accused Nos.

1 and 3 on bail on their furnishing each a personal bond for Rs.20,000/- with two sureties for the like sum each to his satisfaction.

On release, the petitioners-accused Nos.

1 and 3 are directed to report before the Station House Officer, Hindupur II Town Police Station, on every Tuesday between 10 a.m. and 1 p.m. until further orders.

The criminal petition is allowed accordingly.
