10682 OF 2023 JUDGMENT:- 1) Heard Ms.

Popuri Lakshmi Priyanvita, learned Counsel for the Petitioner, learned Government Pleader for Municipal Administration and Urban Development for the respondent No.1, Sri G.Naresh Kumar, learned counsel, representing Sri M.Manohar Reddy, learned Standing Counsel for the respondent No.2 and learned Government Pleader for Revenue for the respondent Nos.

2) Preliminary objection has been raised by Sri.

Naresh Kumar, that the petition filed by the Petitioner is not maintainable, in as-much-as, the Petitioner is an association and in the array of parties, it is represented by the Secretary, but the name of the Secretary has not been mentioned.

He further submits that, the Petitioner has not annexed any resolution in favor of the Secretary to file the petition and even from the by- laws of the association annexed, it is not evident that the 2 Secretary of the association is competent and authorized to file the petition on behalf of the association.

3) At this stage, learned Counsel for the Petitioner submits that the petitioner may be permitted to withdraw the writ petition with liberty to file fresh writ petition.

4) Considering the submissions, the writ petition is dismissed as ‘withdrawn’, but with liberty, as aforesaid.

No order as to costs.
