M/S. SRI RAJA RAJESWARI DEVI OIL CORPORATION vs THE INDIAN OIL CORPORATION LTD.,

THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO.9805 OF 2023 ORDER: The present Writ Petition is filed seeking the following relief: “….to declare the action of the respondents in not considering the case of the petitioner for resitement of the petitioner petroleum retail outlet to any other suitable place in the same category or different category, in spite of submitting representations dated 08.12.2022, 05.08.2020, 03.09.2018 and 02.02.2018 as illegal and arbitrary and consequently direct the respondents to consider the case of the petitioner for resitement of its (MS & HSD) retail outlet dealership in A-category or B-site category in terms of the Circular No.205-10/2012 dated 04.10.2012...” 2.

Heard Sri Kothapalli Sai Sri Harsha, learned counsel for petitioner and Sri SVSS Shiva Ram learned Standing Counsel for the respondents .

Learned counsel for petitioner submitted that, in spite of several representations made by the petitioner regarding resitement of the 2 petitioner’s petroleum retail outlet to any other suitable place in the same category or different category, in terms of Resitement Policy guidelines of the respondent corporation in Circular No.205-10/2012, the respondent-authorities have not acted upon the same.

It would suffice for the time being if the authorities consider the petitioner’s representation and accordingly prayed to pass appropriate orders in that regard.

On the other hand, learned standing counsel for the respondents submitted that, the authorities would consider and pass appropriate orders on the representations so made by the petitioner and orders to the said effect can be passed.

Taking the submissions of both the learned counsel into consideration, and without going into the merits of this case, as there would be no purpose in keeping this writ petition pending, this court is inclined to dispose of the writ petition with the following direction: The 4th respondent herein is directed to dispose of the petitioner’s titioner’s representation dated 08.12.2022 in accordance with law and pass a reasoned order and communicate the same to the petitioners within a period of four (04) weeks from date of receipt of copy of this order.

3 Accordingly, the Writ Petition is disposed of.

No costs.
