SREENIVASA REDDY Criminal Petition No.2515 of 2023 Order: This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/A3, seeking regular bail, in Crime No.401 of 2022 of II Town Police Station, Visakhapatnam City.

A case has been registered against the petitioner and others for the offences punishable under Sections 353 IPC and Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’) and 25 of the Arms Act.

Case of the prosecution, in brief, is that on 23.12.2022, Inspector of Police, II Town Police Station, Visakhapatnam City, along with his staff and mediators found the petitioner and others in possession of 22 Kgs of Ganja and four sharp edged knives.

The contraband and material objects are seized and a case was registered against the petitioner and others.

Heard the learned counsel for the petitioner and learned Special Assistant Public Prosecutor.

A perusal of material on record goes to show that, police seized 22 Kgs of Ganja and four sharp edged knives from the possession of petitioner and others in the presence of two mediators and under the cover of a mediatornama.

The seized 2 quantity would amount to commercial quantity.

As per confessional statements of the accused, at Advani Park they distributed ganja among themselves and threatened the persons coming across them in order to collect money.

It is submitted by the learned Special Assistant Public Prosecutor that investigation is at nascent stage.

In view of the above, the Criminal Petition is dismissed. _____________________ K.
