Jagannadha Rao, standing counsel ORDER This writ petition is filed to declare the action of respondents in withholding an amount of Rs.98,41,029/- payable to the petitioner in relation to execution of works i.e “for formation of Internal Roads beside TIDCO Housing Colony of Ponnuru Municipality under Pedalanadiriki illi-Urban Housing Layout-I, Block D to F”, as illegal and arbitrary.

The petitioner was awarded the above work vide agreement Nos.5 to 7/2020-21 dated 25.06.2020 and inspite of completion of works, amount was not released.

Hence, the writ petition.

Jagannadha Rao, learned standing counsel for respondent No.3.

Learned counsel for respondent No.3, on instructions of General Manager of respondent No.3 did not dispute about execution of works and the amount payable to the petitioner.

He would submit that due to paucity of funds, amount could not be paid.

In view of the above submissions, since there is no dispute regarding execution of work and the amount payable to the petitioner, this Writ Petition is disposed of directing the respondents to pay an amount of Rs. unt of Rs.98,41,029/- within a period of four months from today, on priority basis.

No costs.
