THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION NO.20309 OF 2023 ORDER: The present Writ Petition is filed seeking the following relief: “..declaring the action of respondents in not paying bill amount towards execution work namely Reconstruction of BT Road from Burujupalli to Burujupalli Thanda in Giddalur Mandal 2.40 Km in Prakasam District for an amount of Rs.46,40,395/- as illegal, arbitrary, irresponsible against to the principles of natural justice apart from being violative of Article 21 of the Constitution of India and consequentially direct the respondents to prepare final bills for the above works and pay the same to the petitioner forthwith along with interest in the interest of justice and pass..” 2.

Heard Sri Kambhampati Ramesh Babu, learned counsel for the petitioner, learned Assistant Government Pleader for Panchayat Raj and learned Assistant Government Pleader for Finance.

Learned Assistant Government Pleader for Panchayat Raj on written instructions dated 18.08.2023 submitted that, the authorities have admitted to pay the bill amount to a tune of Rs.41,69,864/- to the petitioner as against the claim made by the petitioner to a tune of Rs.46,40,395/- because of some statutory deductions and sought time eight(08) weeks time for payment.

To the said submission, learned counsel for the petitioner reported no objection.

Taking into consideration the submissions of both the learned counsel, this court is inclined to dispose of this writ petition, at the admission stage with the following direction: The respondents are directed to release the legally admitted/entitled amount to the petitioner at the earliest, and at any rate, within a period of eight(08) weeks from the date of receipt of copy of this order.

It would be open to the petitioner to agitate his claim for interest, if any, payable by the respondents, if he is so advised, in an appropriate forum.

There shall be no orders as to costs. to costs.

Accordingly, the writ petition is disposed of.

No costs.
