THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION No.19813 OF 2023 ORDER:- The present Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the respondents in correction / rectification of fee structures stated in G.O.Ms.No.15 dated 24.03.2020 and G.O.Ms.No.48 dated 23.12.2020 for the petitioners colleges as illegal, arbitrary, irregular, unreasonable and unjust and consequently direct the respondents to correct the fee structure crept in the above said GOs in so far as petitioners college are concerned in the interest of justice and pass such other order or orders…” 2.

Heard learned counsel for the petitioners, learned Government Pleader for Higher Education and learned Standing Counsel for Respondent No.3.

Learned counsel for the petitioners submits that the petitioners herein are imparting technical education in Tirupati District.

These institutions were established in the years 2001 and 2008, respectively.

While so, the 1st petitioner institution fee was previously fixed at Rs.72,700/- and for the 2nd petitioner institution, fee was fixed at Rs.52,500/-.

But, Respondent No.3 revised the fees at Rs.37,000/- for the 1st petitioner and Rs.50,600/- for the 2nd petitioner.

Consequently, the petitioners submitted representations dated 15.10.2020, 31.12.2022 and NV,J W.P.No.19813 of 2023 2 also 02.08.2023 seeking rectification of the mistake crept in forwarding the fee structure proceedings to Respondent No.1.

On the other hand, learned Standing Counsel for the Respondent No.3 submits that since the mistake had crept in while issuing proceedings of Respondent No.3, it can be rectified after considering the same.

Having regard to the submissions made by both the counsel, this Court is of the considered view that this writ petition can be disposed of directing Respondent No. ondent No.3 to consider the representation of the petitioners dated 02.08.2023 with reference to the fee structure fixed for the previous block period, after providing an opportunity of hearing to the petitioners and pass appropriate orders within a period of two weeks from the date of receipt of copy of this order.

It is needless to observe that the order of this Court may not come in the way for ensuing counselling process.

With the above direction, writ petition is disposed of, at the stage of admission, with the consent of both the parties.

There shall be no order as to costs.
