19563 of 2023 ORDER: The present Writ Petition is filed by the petitioner under Article 226 of the Constitution of India, seeking the following relief: “….. to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the respondents in withholding the amount of Rs.6,61,791/- (CFMS No.2022-2376710) even after finalizing the bills payable to the petitioner in relation to the works i.e. “:Balance work of Construction of Compound wall at Pamidimukkala Police Station Building of Krishna District” vide agreement Bond No.39/2022-23 dt.

01.10.2022” is questioned, as the same is illegal, arbitrary and consequently direct the respondents to consider for payment of Rs.6,61,791/- (CFMS No.2022-2376710) with interest @ 24% per annum for the delayed amount to the petitioner….” 2.

Heard Sri Suresh Kumar Reddy Kalava, learned counsel for the petitioner, learned Assistant Government Pleader for Home for respondent No.1, Sri K.C.Venkata Reddy, learned standing counsel for APSPHCL for respondent Nos.2 & 3 and the learned Assistant Government Pleader for Finance & Planning for respondent No.4.

The learned Assistant Government Pleader for Finance & Planning, basing on the written instructions of the Special Chief Secretary, Finance Department, submitted that the AP Housing Corporation has 2 RC,J W.P.

19563 of 2023 uploaded the bill No.2022-2376710 relating to the subject work in the CFMS portal for Rs.6,61,791/- and the bill is waiting for fund clearance and sought three (03) months time for payment.

To the said submission, learned counsel for the petitioner submitted that in similar circumstances, this Court disposed of W.P.No.17411 of 2022 granting six (06) weeks time for payment and prayed to dispose of this writ petition in similar lines.

Taking into consideration the submissions of learned counsel for both sides, this Writ Petition is also disposed of, at the admission stage, in terms of the orders passed in W.P.No.17411 of 2022, dated 28.06.2022.

Accordingly, the respondents are directed to release the admitted/ legally entitled net amount to the petitioner at the earliest, and at any rate, within a period of six (06) weeks from the date of receipt of copy of this order.

There shall be no order as to costs.

As sequel thereto, miscellaneous petition, if any, pending shall stand closed.
