RAGHUNANDAN RAO C.R.P.No.1869 of 2023 ORDER: The petitioner herein, who is defendant in O.S.No.8 of 2018 had filed I.A.No.306 of 2021 on the file of the Additional Senior Civil Judge, Tirupati, under Section 45 of the Indian Evidence Act read with Section 151 of C.P.C., for comparison of the suit promissory note with the admitted signatures of the petitioner by a handwriting expert.

This application was dismissed by the trial Court on 06.03.2023 on the ground that the contemporaneous signatures are not available and the signatures of the petitioner on vakalatnama and written statement cannot be accepted for comparison.

Aggrieved by the same, the petitioner has approached this Court by way of the present civil revision petition.

This Court by order dated 27.09.2023 had directed the trial Court to consider afresh the application of the petitioner for comparison of the signatures, in the light of the documents produced in I.A.No.75 of 2022, with due opportunity of hearing to the plaintiff/respondent.

In such circumstances, nothing further would survive in the present revision petition.

Accordingly, this civil revision petition is dismissed.

There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed. __________________________ R.
