GP FOR REVENUE DR,J W.P.NO.19415 of 2023 The Court made the following ORDER: This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: “…..to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not taking steps for removing the encroachments blocking the donka road through which we are passing to reach my agricultural land in R.S.No.276/3, 276/6 situated at Chinamuthevi Village, Movva Mandal, Krishna District is wholly illegal, arbitrary and violative of Articles 14 and 19 of the Constitution ofIndia and consequently declare that the petitioner is entitled to pass through the donka road located in the northern side connecting the land of the petitioner without any blockage of the said donka road ….” 2.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents.
After notice, the 3rd respondent has filed a counter.
In the counter, it is stated that subsequent to the filing of the writ petition, the respondents have conducted an enquiry and based on the same, it came to the notice of the authorities that fifteen families have been encroached Donka residing in the scheduled land by way of dwelling house for more than 20 years, especially three families have occupied the said land adjacent to the petitioner’s land since from the year 2005 before the sale deed of the petitioner’s land and based on the same, they called the petitioner as well as unofficial respondents and they have removed certain encroachments by providing pathway and accordingly, they have also passed an endorsement disposing of the representation of the petitioner vide endorsement dated 08.09.2022.
The same is filed along with the counter.

Considering the averments made in the counter and also the endorsement, the writ petition is closed.

Accordingly, the writ petition is closed giving liberty to the petitioner to question the same in appropriate proceedings.
