18817 of 2023 ORDER: This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: “to issue a writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not taking any further action pursuant to the proceedings Rc.

97/C3/2023 dated 15.02.2023 issued by the 2nd respondent directing the 3rd respondent to take necessary action and provide periodical increments to the petitioner and also by not considering the petitioners subsequent representation dated 27.05.2023 as illegal, arbitrary and in violation of the Article 14 of the Constitution of India and further direct the 3rd respondent to submit a report to the 2nd respondent pursuant to the said proceedings dated 15.02.2023 and further direct the 2nd respondent to provide periodical increments to the petitioner, who is entitled for the same on par with the other similarly situated teachers ….” 2.

Brief facts of the case are that the petitioner, who was working as PS Head Master of MPP School, Old Kallur, Garladinnemandal, Ananthapurmu District, was suspended from 05-03-2020 to 09-09-2020 on frivolous allegations and later the said suspension period was regularized vide proceedings No.

2515/B1/2018 dated 02.12.2021.

Thereafter, it 2 appears that he was not sanctioned one increment.

Therefore, he made number of representations latest being 27.05.2023.

As no decision was taken on the said representation, the petitioner has approached this Court.

In view of the fact that the representation made by the petitioner on 27.05.2023 is pending for consideration before the 3rd respondent.

Heard and perused the material on record.

In view of the same, this court feels it appropriate to dispose of this writ petition by directing the 3rd respondent to pass appropriate orders on the representation of the petitioner dated 27.05. ted 27.05.2023 in accordance with the proceedings issued by the DEO vide Rc.

97/C3/2023 dated 15.02.2023 wherein the MEO was directed to take necessary action for sanctioning pending periodical increments in respect of the teacher as per the rules, eligibility and submit action report to their office.

The above said exercise shall be completed within a period of four (4) weeks from the date of this order.

Accordingly, this writ petition is disposed of.

There shall be no order as to costs.
