With their consent, the writ petition is being disposed of, at the stage of admission.

The grievance of the petitioners, in the present writ petition, is non-consideration of their representation dated 16.9.2022 seeking allotment of D-Form Pattas in survey No.1952 of Vengalarao Nagar, Nellore Rural Mandal.

Learned counsel for the petitioners, while stating that the petitioners belong to S.C.

Community and they have erected small thatched huts in the land situated in survey No.1952 of Vengalarao Nagar, fairly submits that the land is Government land.

He submits that the petitioners are in possession and enjoyment of the subject matter property for the last several years and made several representations to the respondents for allotment of house-sites in the said land.

He submits that the 4th respondent, after conducting due enquiry, had submitted a report dated 25.11.2020 to the 3rd respondent for taking necessary action in the matter for allotment of house-sites to the petitioners.

He submits that though more than two and a half (2½) years have elapsed, so far no further action, in accordance with G.O.Ms.No.367 Revenue (Assn.I) Department dated 19.8.2019, is taken.

He further submits that though the Government has taken the programme of allotment of house-sites to the landless poor persons as a prestigious one, despite the report of the 4th respondent referred to above, no action has been taken to allot house-sites to the petitioners titioners and therefore, this writ petition is filed.

This Court, vide its order dated 27.7.2023, has granted time to enable the respondents to furnish necessary instructions, more particularly with reference to the representation of the 3rd respondent dated 24.11.2020 and also subsequent representation of the petitioners dated 16.9.2022 to the 2nd respondent.

It appears that no instructions are furnished to the learned Assistant Government Pleader for Revenue so far in this matter.

Be that as it may.

Considering the submissions made and perusing the material on record, this Court deems it not necessary to keep the writ petition pending, and expedient to dispose of the same, with a direction to the 2nd respondent to consider the cases of the petitioners for allotment of house-sites in the light of the communication dated 25.11.2020 and as per the orders of the Government in G.O.Ms.No.367, Revenue (Assn.I) Department, dated 19.8.2019, which are in vogue, as expeditiously as possible, at any rate, within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of.

No order as to costs.
