THE HON’BLE SRI JUSTICE RAVI CHEEMALAPATI WRIT PETITION No.18383 of 2023 ORDER: This Writ Petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking the following relief: “….to issue order, writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the amount of Rs.5,00,000/- towards financial assistance to petitioner’s son Koppula Hemanth as per G.O.Ms.No.29 dated 27.08.2016 under ‘NTR Videshi Vidyadarana’ despite sanction of funds by the Government with Application ID No.OV2019123080 as illegal, arbitrary and unconstitutional and consequently direct the respondents to pay the amount of Rs.10,00,000/- towards financial assistance to the petitioner’s son Koppula Hemanth under Application ID No.OV2019123080 and to pass such other order or orders…..” 2.

Heard Sri Ramesh Babu Talluri, learned counsel for the petitioner, learned Assistant Government Pleader for Social Welfare appearing for respondent Nos.1, 3 to 5 and learned Assistant Government Pleader for Finance & Planning appearing for respondent No.2.

Learned Assistant Government Pleader for Social Welfare, on written instructions dated 02.08.2023 submitted that, the petitioner’s son has been selected as beneficiary under the scheme of NTR Videshi Vidyadarana for studying MSC International Technology Transfer Management Course in FACHHOCHSCHULE DESMITTELSTANDS (FHM) University, Germany and further out of Rs.10 lakhs financial assistance under the scheme, a bill for Rs.5 lakhs was uploaded and the remaining balance of Rs.5 lakhs will be paid as and when budget released by the Government and sought some time for payment.

To the said submission, learned counsel for the petitioner submitted that, the said instructions of learned Assistant Government Pleader for Social Welfare may be recorded and prayed to pass appropriate orders in that regard.

Taking the submissions of both the learned counsel into consideration, this Court, instead of keeping the Writ Petition pending, is inclined to dispose of the same, at admission stage itself, with the following direction: The respondent authorities are directed to release the admitted/legally entitled amount towards the financial assistance to the petitioner’s son as per G.O.Ms.No.29 dated 27.08.2016 under NTR Videshi Vidyadarana within a period of six (6) weeks from the date of receipt of a copy of this order.

There shall be no order as to costs.
