SURESH REDDY CRIMINAL PETITION No.

5181 OF 2023 ORDER: This present Criminal Petition, under Sections 437 and 439 of Cr.P.C., is filed by the petitioners/Accused Nos.

1 to 3 seeking their release on bail in Crime No.

197 of 2023 of Anantapur I Town Police Station, Ananthapuram District.

The above Crime was registered against the petitioners herein and others for the offence punishable under Section 306 read with Section 34 IPC.

Karibasaiah, learned counsel appearing for the petitioners/Accused Nos.

1 to 3, and learned Special Assistant Public Prosecutor appearing for the respondent- State.

Brief facts of the case that the de-facto complainant and her husband, who were residents of Guntur District, migrated to Ananthapuram about 30 years back and they have been living in Ananthapuram by running a publication shop at Kamala Nagar.

The de-facto complainant has got an agricultural land in an extent of Ac.5.68 cents in survey No.

102-1-B of Kurugunta Village, Ananthapuram Mandal, having purchased the same about 20 years back.

Title deeds and 2 other revenue records are in the name of de-facto complainant.

While so, Accused Nos.

1 to 3 were trying to manipulate revenue records with the help of Accused No.4, who is a Revenue Inspector and were trying to knock away the agricultural land belonging to de-facto complainant.

On that, the de-facto complainant approached the offices of Tahsildar and Revenue Divisional Officer, but there was no response.

Ultimately, on 16.06.2023, husband of de-facto complainant committed suicide by hanging himself to a ceiling fan at his house.

During the course of investigation, the Police arrested Accused Nos.

1 to 3 and remanded them to judicial custody.

The learned counsel for the petitioners contends that the Accused No.4 was already granted Anticipatory bail before this Court vide order, dated 13.07.2023 passed in Crl.P.No.4533 of 2023 and further the petitioners/Accused Nos. cused Nos.

1 to 3 herein are in judicial custody since 18.06.2023.

As such, the learned counsel for the petitioners requested this Court to enlarge the petitioners/Accused Nos.

1 to 3 on bail.

On the other hand, the learned Special Assistant Public Prosecutor has produced a copy of the suicide letter purported to have been written by the deceased, in which it is 3 stated that Accused Nos.1 to 3 along with Accused No.4 were trying to manipulate revenue records, and that Accused Nos.

1 to 3 and 5 were already arrested and remanded to judicial custody.

Taking into consideration and facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/Accused Nos.1 to 3, on the following conditions. (i) The petitioners/Accused Nos.1 to 3 herein shall be released on bail on their executing personal bonds for Rs.10,000/-(Rupees Ten thousand only) each with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate, Ananthapur. (ii) Further, the petitioners are directed not to hamper the investigation and tamper with the prosecution witnesses.
