Secretariat, Velagapudi, Amaravathi, & four others. …Respondents Dt.: 23.08.2023 P.C.: This writ petition, in the nature of public interest litigation has been filed highlighting the inaction on the part of the official respondents to rebuild the collapsed bridge across Yerrakaluva situated in between the Madhavaram Village, Tadepalligudem Mandal and Kamsalipalem Village, Nidadavole Mandal of West Godavari HCJ & AVSS, J W.P (PIL).No.94 of 2023 2 District, for which it is stated that some amounts have been allocated during the budget allocation process.

Learned counsel for the respondents however states that the assertion of the petitioner is not correct as much as tenders were invited for construction of high-level bridge vide “e” NIT No.3/MDR-PLAN/ENC(MDR)/DCE(R)/ EE(TEC)/DEE-6/AEE-4/2023, dated 24.04.2023 and the last date of receipt of tenders pursuant thereto was fixed on 16.05.2023.

It is stated that no response was elicited from the bidders and hence, the second call was also made vide “e” NIT No.8/MDR-PLAN/ENC(MDR)/DCE(R)/ EE(TEC)/DEE-6/AEE-4/2023, dated 26.05.2023 and the last date for the receipt of tenders was fixed on 16.06.2023, which also failed to elicit any response whatsoever from the eligible bidders.

It is therefore stated that the Department would make an effort yet again to invite bids and the needful would be done within a period of two months from today.

In that view of the statement made by learned Government Pleader for Roads and Buildings Department, we do not deem it absolutely necessary to proceed with the HCJ & AVSS, J W.P (PIL).No.94 of 2023 3 present writ petition (PIL), which is accordingly disposed of.

It would be open to the petitioner to approach this Court again, in case if any cause survives.

No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
