CHALASANI AJAY KUMAR The Court made the following: 2 HN, J CRL.P.NO.4663 OF 2023 THE HONOURABLE SRI JUSTICE HARINATH.N CRIMINAL PETITION NO: 4663/2023 ORDER:- The petitioner is aggrieved by the order passed in Crl.M.P.No.48 of 2019 in C.C.No.180 of 2017.

The petitioner had filed Crl.M.P seeking to send Exhibit P1 and P2, promissory note and cheque to the Regional Forensic Laboratory for expert opinion with regard to difference of signatures in vakalath and Exhibit P1 and P2.

Learned Magistrate has considered their petition on merits and dismissed the same.

The PW-1 in cross-examination has stated that the promissory note and cheque were not given at the same time, that it was also observed by the learned Magistrate, that the complaint was of the year 2017 and the petition was filed at a belated stage only.

Learned counsel for the petitioner submits that the matter is coming up for arguments.

However, this Court finds no grounds to interfere in well considered order and admittedly the criminal case in C.C.No.180 of 2017 has been pending for the last eight (08) years.

The petition filed by the petitioner was dismissed on 29.03.2023, and there is no explanation as to why the petition was filed on 07.07.2023, that apart this Court, also considered view that the petition filed by the petitioner is only to drag on the matter, without further proceeding in the trial Court.

CRL.P.NO.4663 OF 2023 Considering the stage of the case, and also the matter is coming up for arguments, this Court is not inclined to interfere.

Accordingly, this Criminal Petition is dismissed.
