HON’BLE SRI JUSTICE K.

SURESH REDDY Criminal Petition No.4512 of 2023 ORDER: Accused No.2 in Cr.No.12 of 2023 of SEB, Seethammadara Station, Visakhapatnam District, filed the present criminal petition under Sections 437 and 439 of Cr.P.C. seeking to enlarge her on bail.

The above said crime was registered for the offences under Sections 20(b)(ii)(c) read with 8(c) of the Narcotic Drugs & Psychotropic Substances Act, 1985.

Case of the prosecution in brief is that, on 25.02.2023, on credible information, the Assistant Sub Inspector of Police, SEB, Seethammadara PS, along with his staff and mediators, went to Scooter parking, Gnanapuram Entrance, Visakhapatnam Railway station, where they found the petitioner and two others in possession of 60 Kgs of ganja.

After conducting panchanama, the police seized the contraband, arrested the petitioner and others and remanded them to the judicial custody.

As seen from the record, earlier learned counsel for the petitioner filed Crl.P.No.3320 of 2023 on behalf of the petitioner seeking her release on bail, which was dismissed on 20.06.2023, as the contraband involved in the present case is 60 Kgs, which is a commercial quantity.

Once again, the petitioner filed the present application, seeking release of the petitioner on bail, suppressing the fact of dismissal of the earlier bail application.

Learned counsel for the petitioner in the earlier application and in the present application is one and the same.

Apart from that, it is mentioned in the present bail application that ‘this is the first bail application filed before this Court’.

Be that as it may, as the earlier bail application was dismissed by this Court on 20.06.2023 in view of the huge quantity recovered from the possession of the petitioner and as there are no changed circumstances in the case, this Court is not inclined to grant bail to the petitioner.
