SURESH REDDY Criminal Petition No.4516 of 2023 ORDER: Accused No.1 in Cr.No.228 of 2023 of II Town Police Station, Srikakulam, filed the present criminal petition under Sections 437 and 439 of Cr.P.C. seeking to enlarge her on bail.

The above said crime was registered for the offences under Sections 370(2), 370(A)(2) of IPC and Sections 3(2)(a), 4(1), 5(1)(a), 6(1)(b), 7(1)(a) of Immoral Traffic (Prevention) Act, 1956.

Case of the prosecution in brief is that, Accused Nos.1 and 2 are running brothel house and Accused Nos.3 to 7 are their customers.

A.1 used to run bangle shop at Ryotbazar and A.2 used to help A.1 in running the brothel house.

It is alleged that A.1 and A.2 are the organizers of the said house and they are procuring customers and doing prostitution business.

On 19.06.2023, the Inspector of Police, Srikakulam Rural Circle, raided the house of A.1 and apprehended A.1 and A.2 and also the customers, A.3 to A.7.

Petitioner/A.1 and A.2 were arrested and after preparing panchanama, they were remanded to judicial custody.

So far as A.3 to A.7 are concerned, the police have issued notices to them under Section 41-A of Cr.P.C.

Learned counsel for the petitioner contends that as the petitioner is in judicial custody since 19.06.2023, he requested this Court to enlarge the petitioner on bail.

On the other hand, learned Assistant Public Prosecutor, on instructions, states that the petitioner has not involved in any similar crimes previously.

This Court perused the entire material on record.

As seen from the record, as the petitioner is in judicial custody since 19.06.2023 and A.2 was also granted bail by the Court below, this Court is inclined to grant bail to the petitioner/A.1.

The petitioner/Accused No.1 herein shall be released on bail on her executing a personal bond for a sum of Rs. sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for the like sum each to the satisfaction of the II Additional Judicial Magistrate of I Class, Srikakulam.

On such release, the petitioner is directed to report before the Station House Officer concerned, once in a week i.e., on every Sunday between 10.00 a.m. and 1.00 p.m., until further orders.
