Vutupalli Rajanna Counsel for R-1 to R-4 : G.P for Revenue Counsel for R-5 to R-14 : ----- Counsel for the R-15 : G.P for Stamps & Registration ORDER: The Writ Petition is filed seeking the following relief:- “…..declaring the action of the 4th respondent in trying to evict the petitioners highhandedly from their property admeasuring an extent of Ac.3.45 cents in Sy.No.704 situated in Motakatla village, Sambepalli Mandal, Annamayya District; at the behest of respondents 5 to 14 which is subject matter of an Appeal ROC.D/332/2022 pending on the file of 3rd respondent is illegal, arbitrary, highhanded and violation of principles of natural justice and also violation of Article 19, 21 and 300-A of Constitution of India and consequently direct the 4th respondent not to dispossess the petitioners from the property admeasuring an extent of Ac.3.45 cents in Sy.No.704 situated in Motakatla village, Sambepalli Mandal, Annamayya District….” 2 2.
Heard learned counsel for the petitioner.
Also heard learned Assistant Government Pleader for Revenue representing the respondents 1 to 4.
Notice to respondent Nos.5 to 14 is deemed not necessary as the matter is being disposed of without going into the merits of the case.

On perusal of relief sought for in the Writ Petition, the grievance of the writ petitioner appears to be inaction on the part of the 2nd respondent in disposing of the Appeal stated to have been filed in 2022.
The learned counsel submits that due to pendency of the appeal, the petitioners are subjected to serious prejudice and seeks a direction for early disposal of the same.

Considering the same, this Court without going into merits of the case, is inclined to dispose of the writ petition with a direction to the 3rd respondent to dispose of the Appeal bearing ROC.D/322/2022, as expeditiously as possible, at any rate, within a period of eight weeks, after giving due opportunity to the petitioner and respondents 5 to 14 and pass appropriate orders strictly, in accordance with law, including on the maintainability of the same.
3 The Writ Petition is accordingly disposed of.
There shall be no order as to costs.
