15179 of 2023 ORDER: This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief: “to issue a Writ Order particularly in the nature of Writ of Mandamus or any other appropriate Writ Order or direction, directing the respondents strictly adhere to the orders of the Hon'ble High Court dated 15-9-2015 in W.P.No.38060 of 2013 and also Memo issued by the Government of Andhra Pradesh vide Memo No.7342/G2/2015-8, dated 24.5.2016 and pass such other order”.

V.V.Prabhakara Rao, learned counsel for the petitioners and the learned Government Pleader for respondents.

Learned counsel for the petitioners represented that the issue involved in this writ petition is squarely covered by the common order of this Court dated 27.12.2021 passed in W.P.No.17665 of 2021.

The operative portion of the said order is as follows: i) The respondents shall consider cases of the Writ Petitioners for appointment as MPHAs within a period of four (04) weeks from the date of receipt of copy of this order, in terms of Memo No.7342/G2/2015-8, dated 24.05.2016 based on 2 their merits, if any candidate less meritorious than the Writ Petitioners are appointed; ii) If any of the Writ Petitioners have not submitted the relevant certificates/documents they should be called upon to submit the same by granting reasonable time of not less than four (04) weeks; iii) In the event of any genuine objection for considering the case of any of the Writ Petitioners, they shall be notified the same by issuing appropriate notice/communication and afforded an opportunity before taking further action in the matter." 4.

Learned Government Pleader for respondents has opposed the matter and sought time for filling the counter-affidavit, since as per his instructions, there are no vacancies available to accommodate the petitioners.

The said contention was disputed by the learned counsel for petitioners.

However, the submission of the learned Government Pleader for respondents, is rejected, on the ground that this Court has already passed orders in similar matters.

However, if any difficulty is there in considering the case of the petitioners, the respondents can take appropriate proceedings as held by this Court in W.P.No.17665 of 2021 and batch, dated 27.12.2021.

Having regard to the facts and circumstances, this Writ Petition is disposed of, in terms of the order passed in 3 W.P.No.17665 of 2021 and batch, dated 27.12.2021.

No order as to costs.

The Registry is directed to attach a copy of the order in W.P.No.17665 of 2021 and batch, dated 27.12.2021, to this order.
