SURESH REDDY Criminal Petition No.4278 of 2023 ORDER: A.3 in Cr.No.87 of 2023 of Gudipala Police Station, Chittoor District filed the present application under Section 438 of Cr.P.C., seeking anticipatory bail.

The said crime was registered for the offences under Sections 332 read with 34 of IPC and Sections 7(B) read with 8(B) of Andhra Pradesh Prohibition (Amendment) Act, 2020.

Case of the prosecution in brief is that, on 19.05.2022 at about 7.30 p.m., the Head Constable, Gudipala PS, along with his staff, apprehended A.1 to A.4, who were found selling ID arrack.

On seeing them, the police personnel rushed there and caused enquiries.

In the meanwhile, A.2 absconded from the spot and the police caught the remaining persons.

Thereafter, A.2 came to the spot along with some other persons and took away the remaining accused by obstructing the legitimate duties of the police personnel.

On verification, the police found 50 sachets of ID arrack.

Learned counsel for the petitioner contends that the petitioner has been implicated in the present crime and that no contraband is seized from the petitioner and hence, the petitioner may be granted anticipatory bail.

On the other hand, learned Assistant Public Prosecutor, opposed the bail application.

Heard and perused the entire material available on record.

Though the crime was registered on 19.05.2022, till today, the Investigating Officer could not apprehend the petitioner.

Further, no contraband is seized from the house of the petitioner.

In that view of the matter, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

The petitioner/A.3 is directed to surrender before the Station House Officer, Gudipala Police Station, Chittoor District, within a period of one week from today.

On such surrender, the Station House Officer is directed to enlarge the petitioner/A.3 on bail on his furnishing a personal bond for a sum of Rs. sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for the like sum each to his satisfaction.

On such release, the petitioner is directed to report before the said Station House Officer, once in a week i.e., on every Sunday between 10.00 a.m. and 05.00 p.m., until further orders.

The petitioner is directed to cooperate with the investigation and not to tamper with the prosecution witnesses.
