THE HON’BLE SRI JUSTICE K.SURESH REDDY Criminal Petition No.3733 of 2023 ORDER: This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, has been filed by the petitioner/Accused No.5, seeking regular bail, in Cr.No.42 of 2023 of Government Railway Police Station, Vizianagaram.

A case has been registered against the petitioner herein and others for the offences punishable under Sections 8(c) r/w.20 (b) (ii) (C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short “the NDPS Act”).

Heard and perused the record.

On a perusal of the material available on record, it goes to show that after receipt of credible information, on 10.10.2023 at about 8.45 PM, Accused Nos.
1 to 5 were apprehended by the police, while they were travelling in Train No.08552 Kirondole to Visakhapatnam passenger in between Malliveedu to Kothavalasa Railway Stations, then the police apprehended them and when questioned in the presence of mediators, they confessed that they are in possession of 120 2 Kgs of Ganja.
After conducting of panchanama, the police arrested the Accused No.1 to 5 and remanded them to judicial custody.

It is contended by the learned counsel for the petitioner that the petitioner was falsely implicated in this case and requests to enlarge her on bail.

Per contra, the learned Assistant Public Prosecutor submits that the petitioner was involved in other similar cases and prays to dismiss this petition.

As could be seen from the record, the contraband seized from the possession of the accused is 120 kgs, which is a commercial quantity.
In view of the same, this Court is not inclined to grant bail to the petitioner herein.

Accordingly, this Criminal Petition is dismissed.
