SREENIVASA REDDY Criminal Petition No.3294 of 2023 Order: This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioner/A-1, seeking regular bail, in Crime No.154 of 2023 of Rampachodavaram Police Station, East Godavari district.

A case has been registered against the petitioner herein and others for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Brief facts of the case are that, on 06.10.2021, at about 07.00 AM, at Pandirimamidi village centre, SH-41 road, Rampachodavaram Mandal, the Sub-Inspector of Police, along with his staff and mediators, conducted vehicle checking and found the petitioner herein and others in possession and illegal transportation of 240 Kgs of Ganja in 8 white coloured plastic urea bags worth Rs.4,80,000/- from Visakhapatnam Rural interior forest area to Rajahmundry.
The contraband, along with crime vehicles and other material, was seized under cover of a mediators report and a case was registered against the petitioner herein and others.

The petitioner herein was arrested on 01.02.2022 and since then he is languishing in jail.
Statutory period of 180 days is completed, but the police neither filed any charge sheet within the 2 stipulated time nor filed any application for extension of time for investigation.

In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner herein shall be released on bail on his executing personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Rampachodavaram. (ii) On release, the petitioner shall appear before the Station House Officer concerned once in a week i.e. on every Friday between 10. etween 10.00 a.m. and 01.00 p.m., till filing of the charge sheet.
