SREENIVASA REDDY Criminal Petition No.3190 of 2023 Order: This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioners/A-5 and A-6, seeking regular bail, in Crime No.8 of 2023 of Duvvur Police Station, YSR Kadapa District.

A case has been registered against the petitioners herein and others for the offences punishable under Sections 489-C, 489-B IPC, Sections 20(b)(ii)(C), 15 (c) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Perused the record.

On a perusal of the material on record goes to show that 30 Kgs of Ganja and 7 fake currency notes of Rs.500/- denomination were seized from the possession of A1 to A5.

The petitioners herein are alleged to have purchased 6 Kgs of Ganja from A1.

The petitioners herein were arrested on 11.01.2023 and 23.02.2023 respectively and since then they are in judicial remand.

It is represented by the learned Assistant Public Prosecutor that major portion of investigation has been completed.

In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners herein, on the following conditions.

2 (i) The petitioners herein shall be released on bail on their executing personal bonds for Rs.10,000/- (Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Mydukur. (ii) On release, the petitioners shall appear before the Station House Officer concerned twice in a week i.e. on every Wednesday and Friday between 10.00 a.m. and 01.00 p.m., till filing of the charge sheet.
