SREENIVASA REDDY Criminal Petition No.3214 of 2023 Order: This Criminal Petition, under Sections 437 and 439 of Cr.P.C., has been filed by the petitioners/A-7 to A-10, seeking regular bail, in Crime No.21 of 2023 of Bandi Atmakur Police Station, Nandyal District.

A case has been registered against the petitioners herein and others for the offences punishable under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’).

Brief facts of the case are that, on 10.03.2023, at about 07.00 hours, on credible information, the Inspector of Police, BAndi Atmakur Police Station, along with his staff and mediators, reached A.

Koduru village of Bandi Atmakur Mandal, and found A1 to A10 in possession of 11 Kgs of Ganja.

The contraband, along with other material, was seized under cover of a mediators report and a case has been registered against the accused.

Learned counsel for the petitioners submits that the petitioners are falsely implicated in the present crime.

The alleged quantity of Ganja seized from the possession of the accused is not a commercial quantity.

Material part of the investigation is already completed.

On the contrary, learned Assistant Public Prosecutor opposed the petition on the ground that the investigation is not completed.

The petitioners herein were arrested on 10.03.2023 and since then they are in jail.

The quantity of Ganja allegedly seized from the possession of the accused is 11 Kgs, which does not amount to commercial quantity.

In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners herein, on the following conditions. (i) The petitioners herein shall be released on bail on their executing personal bonds for Rs. ds for Rs.10,000/- (Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Nandyal. (ii) On release, the petitioners shall appear before the Station House Officer concerned once in a week i.e. on every Friday between 10.00 a.m. and 01.00 p.m., till filing of the charge sheet.
